TERMS AND CONDITIONS

sportroom Inc. (“sportroom” or “Platform”) is a social platform connecting local people with various sports activity organizers based on their geo positions.  The Platform does not organize any sports activities.  By participating in a sports activity, you, as a user of the Platform, assume risks and release sportroom, waive any and all claims against sportroom and indemnify sportroom in accordance with the following:

ASSUMPTION OF RISKS:

I understand and acknowledge the inherent risks associated with participating in any sports activity, tournament and event, including but not limited to, soccer, cricket, basketball, volleyball, tennis, hiking, pickleball offered via the Platform, damage to property. I recognize that any sports activity, tournament and event, including but not limited to, soccer, cricket, basketball, volleyball, tennis, hiking, pickleball, offered via the Platform may take place on venues and fields with variable and unpredictable conditions, involving unpredictable participants, weather conditions, and man-made obstacles or equipment that may change without notice. These factors may contribute to the risk, danger, or hazard inherent in participating in any sports activity, tournament and event, including but not limited to, soccer, cricket, basketball, volleyball, tennis, hiking, pickleball offered via the Platform, which could lead to serious injury to myself or damage to my property.

I am aware that the nature of sports activities involves injuries, and I willingly accept and assume all associated risks, dangers, and hazards while participating, competing, spectating, or attending any sports activity, tournament and event, including but not limited to, soccer, cricket, basketball, volleyball, tennis, hiking, pickleball offered via the Platform. I fully acknowledge that these risks may result in personal injury, death, property damage, or loss. I understand that the potential dangers may be caused or contributed to by negligence on the part of the Platform, other individuals, or participants, including a failure to take reasonable steps to protect me from the risks involved in participating in the sports activities, tournaments and events, including but not limited to, soccer, cricket, basketball, volleyball, tennis, hiking, pickleball offered via the Platform.

I also recognize that engaging in the sports activities, tournaments and events, including but not limited to, soccer, cricket, basketball, volleyball, tennis, hiking, pickleball offered via the Platform requires physical effort, and I understand the importance of consulting with a doctor before engaging in such intense and demanding physical activities.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT:

In consideration of being able to participate, compete, spectate, or attend any sports activity, tournament and event, including but not limited to, soccer, cricket, basketball, volleyball, tennis, hiking, pickleball offered via the Platform I, on behalf of myself, my heirs, executors, administrators, successors, and assigns, hereby release, waive, and forever discharge the Platform, its owners, directors, sponsors, and all their respective agents, employees, volunteers, officials, servants, contractors, representatives, successors, assigns, participants, and attendees (collectively referred to as the "Releasees") from all claims, demands, damages, costs, expenses, actions, and causes of action, whether in law or equity, related to death, injury, loss, or damage to my person or property, regardless of the cause, arising from my participation in or attendance of any sports activity, tournament and event, including but not limited to, soccer, cricket, basketball, volleyball, tennis, hiking, pickleball offered via the Platform.

This release includes claims based on negligence, breach of contract, or breach of any statutory duty of care, including duties under the Occupiers Liability Act, RSBC. 1996 c. 337, Occupiers’ Liability Act, R.S.O 1990, c. O2, Occupiers’ Liability Act, RSA 2000, c O-4, and similar legislation in other provinces of Canada on the part of the Releasees. I acknowledge that the Releasees may be negligent or fail to take reasonable steps to safeguard or protect me from the risks, dangers, and hazards associated with participating in or attending any sports activity, tournament, and event, including but not limited to, soccer, cricket, basketball, volleyball, tennis, hiking, pickleball offered via the Platform.

I also commit to indemnify, hold and save harmless the Releasees from any and all liability incurred by any or all of them, arising from or in any way connected with my participation in or attendance of any sports activity, tournament, and event, including but not limited to, soccer, cricket, basketball, volleyball, tennis, hiking, pickleball offered via the Platform.

Additionally, I hereby authorize sportroom to utilize photographs, audio tapes, and/or videotapes featuring my presence in any materials, including videos, films, recordings, still photographs, or articles related to sportroom, its programs, and services. This permission extends to various mediums such as television, radio, websites, social media, or any other platform, for purposes including but not limited to brochures, newsletters, or reports.

By clicking the "Agree and continue" button, I confirm that I have read and understood the preceding ASSUMPTION OF RISK, RELEASE OF LIABILITY, WAIVER OF CLAIMS, & INDEMNITY AGREEMENT. I am fully aware that, by doing so, I am voluntarily waiving some of my legal rights.
